My self and my wife both are on H1B. Both are working for different companies.
I filled I 485, EAD and AP through my company, for my self and my wife.
Questions:
1) I am the primary person. After getting the EAD, Is it possible, If my wife can open a consulting company with her name?
2) After opening a consulting company on her name, Is it possible, she can leave her H1B employer and run her own paystubs on her own company.
Your help will be really appreciated. :)

my lawyers have indicated that i would need a 551 stamp in the passport if the card doesn't arrive on time, using AP etc is not an option.

which help to get overtime for full time employee.
I know if you consultant you get paid by hours but not when you become full time employee.
Overtime is paid only if you are a non-exempt employee - usually means you get paid hourly. If you are an exempt employee, then you are not eligible for overtime. Not sure if this is different in different states, but that is how it works in Ohio.

4) Once you get 3 year H1B extension i.e. after Jan08, there are legal ways to tranfer H1B to a new company for the remaining duration but this MUST be discussed throughly with an imigration lawyer as it can be risky and very case dependent.
Remember an employer might try to revoke the I140 in an effort to regain the underlying LC for some other employee, although a retro'ed EB3 might not be too juicy a carot for anyone nowadays.
This may not be that difficult as you sounded. My understanding (ofcourse I am not a lawyer got to this conclusion based on my reading various posts and lawyer responses to my own and other queries) is that once you get three year extension based on approved I140, you are good to transfer. What happens if the previous employer withdraws your approved I140 - thats a grey area but most people suggest that it does not affect "H1B" status; it might affect I485 (if its applied with I140 concurrently). To be in safe side after moving to the new company immediately apply PERM/I-140.
Also I think you can do the transfer before getting the extension, basically if you get an offer from a new employer you can apply for transfer+extension at the same time if you time it right.
Let me know if my understanding is not right above.

Guys I am posting this under General Information knowing that this is definitely not an immigration related question. So, please control your urge for giving negative reps. I have booked a wheelchair for my mom who cannot walk properly in Frankfurt airport during her transit of flights. Do they generally take them till the next flight gate? Also, there is only one hour time gap between these 2 flights? Will this be sufficient for them to take her to the next flight gate. Has anyone used this service for your parents and what are their experiences?

Go ahead - there is no problem at all. My parents traveled to Detroit from Bangalore via Frankfurt by Lufth. The had a nice experience - they were taken from one gate to the next by one of those battery operated carts. Everything went smoothly and they did not have to wait much at all (other than the wait during the layover time). Even at Detroit the service was really good - although the guy who got my parents to the exit asked me for tips (which I had ready - but was surprised that he asked for tips - this was the first time someone asked me for tips directly in the US).

Hi everyone,
I applied for my I-131, I-765 and I-485 together under EB-2 category on the 13th of September 2010. I got approval letters for both I-131 and I-765 by the 9th of November 2010. My wife and I also received our EAD cards and travel documents. But today I got another set of receipts for both I-765 and I-131 with rfe for photographs. The receipts number are different in both the previous and new receipts and the new ones are showing up in pending state on the USCIS website.
Please let me know what can be the reason I got these duplicate receipts and what should be the next steps.

Take Infopass and talk to them. In my opinion if you have approvals in your hand, they stand valid.

I have a question regarding Multiple I-140s.
I applied for I-140 (PD: 2006) and it got approved in 11/2006;
I applied for LC-sub (PD:2004) and it is pending with USCIS
I applied for 485 in July 2007, My question is which PD will USCIS consider? Does it take the one with approve I140 or the pending one ? form 485 does not show the PD anywhere.

How is that relevant? The guy said the date is not current.
I'm guessing the email he got was a standard form email created before July fiasco when having an open 485 application pretty much meant your date was current. Now this is no longer relevant. They won't make a decision until the PD becomes current, and even then they may follow up with RFE about whether he still holds the same position, etc. So pretty much he shouldn't expect to hear anything from them in 60 days regardless of what he email says.

Hi,
I have 2 lawyers to select from. Both are good. One of them is the lawyer company (his office locate in the same city) which is the most expensive. The other lawyer is really good and his expenses is pretty good.
My question is that: Is it better to stuck with the company lawyer as he can handle the perm better. That may because he knows well where to advertise? Or it does not matter? I am just worried that the lawyer that live in another state will not know very well about the city and where he should advertise.
As anyone think, I also want to make sure that he does not over advertise such that we may get many applicants?
Please advise me if I should stuck with the company lawyer or it does not matter?

My wife and I are scheduled to go for fingerprinting this month. We have a year old son and obviously we are planning to take him with us as well. Do I need to take any form of ID / birth certificate of my son (obviously he is not to be fingerprinted) but not sure what the rules are with respect to carrying infants for the interview. Anyone who has fingerprinted in a similar situation?
We took our 17 month old daughter with us. You should not have a problem with that.
BTW, The only problem we had was that our daughter was scared of the tough looking security guy and she started crying as soon as she saw him and we had a hard time consoling her :)
