Hi folks,
I am on H1B visa currently, set to expire in two months from now (end of September). I need to get my H1B renewed for the next 3 yrs. Due to unavoidable reasons my lawyer has not been able to file for the renewal yet.
My questions are -
1. Do I need to have the approval notice before my expiration date?
2. I plan to travel internationally in November. Would the receipt notice be acceptable to reenter? Or do I need the approval notice?
Any suggestions are most welcome. Thanks in advance.

Returning to the US after living abroad for 9 years and need to know what is the best process for my wife to re-apply for green card.
History:
My wife and I have been married for 20 years, own a home in the US and have one child who holds a US passport. While living in the US my wife held a Green Card. However, when we moved she surrendered the card. Now we are returning to the US and she need to get the Green Card once again. Does she need to apply as if this is the first time or is there an application or process for previous residents or Green Card holders?

I dont think that holds true. If you follow you'll see they have been approving cases even in December for 2003 when the PD has been retrogressed to 2002 for December.

Hello Sir/Madam,
I came to US on H1B visa and recently i switched my job.My previous employer (INDIAN Employer) is asking me to return original H1 petetion which they filed.
Can anyone please help me with below queries
1. Do i need Original petetion from previous employer for Green Card processing ?.
2 Should i return H1 petetion or not to my previous employer ?.
2. Is it legal requirement that i need to return original H1 petetion to previous employer who filed it ?.
I would really appreciate and thankful , if you clarify my doubts.

You can return top part of petition and keep lower part with you. Before giving back just make a noterized copy with you. just in case.

If you don't have photo copy then ask your lawyer, they always keeps copy of 485 documents before sending to USCIS. you should be able to get another one from India.

My baddest of the bad phases started recently when I lost my wife's birth certificate from India. Worst part is we dont have backup (no photo copies of it).
Anyways, We are waiting in the 485 queue, working on EADs. Question to all folks, do still need birth certificate now for the green card process, as we have already sent the application?
And how bad it is with redtape/corruption in India, to get another birth certificate from my wife's birth hospital, when we try by ourselves (I mean not involving our/her parents), when we visit India next time (maybe for a month)?

Per Aug 2008 Bulletin, my dates are current.
But My and My spouse's 485 is transferred to NBC sometime back (we never heard anything)
My daughters 485 is still at TSC.

If I transfer my H1-B now to another company, then do I automatically get another 3 years or do I have to file an extension after my H1-B has been transferred?
if you get transfer, new employer will have new LCA with new dates in it (as applied) and employer will fill I-129 with new dates. So when USCIS replies with I-797A there will be I-94 attached that matches new requested dates. So it will get extended to the end of new contract or 3 years, whichever happens sooner, because USCIS does not grant you presence for more than 3 years at once.

Hi,
I have AOS and was recently laid off from my job. As I haven't found another job by the removal-from-payroll deadline, my H1B will expire. My question is, once I get my EAD, can I apply for a new H1B. The motivation is that I can bring a spouse over on a dependant visa only on H1B but not on AOS. How should I work this out?

My lawyer initiated the PERM process late last year, the timeline was such that the prevailing wage request was filed with State Workforce Agency (SWA) on 12-30-2009. The SWA prevailing wage determination was received back by my lawyer on the 1/11/10.
Subsequently the recruitment process started and everything was going smooth. The PERM was supposed to be filed in the first week of April. My lawyer now is saying that they need to push the application filing because of the new rule which came into effect Jan 1st which requires all prevailing wage requests to be filed with the DOL. The rule states that:
On January 1, 2010, the U.S. Department of Labor (DOL) changed the way that prevailing wage determinations (PWDs) are processed for the PERM, H-1B, H-1B1 (Chile/Singapore), E-3 (Australia), and H-2B programs. PWDs are now issued by DOL�s National Prevailing Wage and Helpdesk Center (NPWHC) in Washington, DC. Below are updated Frequently Asked Questions about the new process.
From my understanding the new law should not be applicable to me, since we filed for the PWD on 12/30/09. I am not sure why we need to reinitiate the process, since the new law is _effective_ as of 01/01/2010.

She has the F1 stamped on the passport which is valid until Dec 2009 I think. She is finishing much before that. Does it mean she will not be able to reenter on either F1 visa or the EAD?

It was a mistake by the guy who stamped I-94 (at CBP).
Her H-4 must be expire on your expiration date.
You need to go to nearest CBP office to get it corrected.
She need deferred inspection to get it straight. USCIS will not do it.
OR Do nothing about it and file H-4 extension along with your H1B extension.
If you do not extend her with your petition, even if she have valid I-94, she may end up in trouble later.

My wife is on H4 visa (expiring in 3-20-2013 since she got 5 yr multiple visa). Recently she visited Kuwait and on her re-entry she was given entry (on her I94) up to 3-15-2013 (up to 5 days prior to her visa expiration). Will she also need extension in this case along with my extension or can she stay in US till 2013 with out extension Thanks.
